Villarreal Houston Soccer Academy
Terms of Service, Membership Agreement & Club Policies
By registering for any Villarreal Houston Soccer Academy program, team, camp, clinic, league, training session, event, or service, the parent/guardian and participant acknowledge that they have read, understood, and agreed to the following policies and terms.
1. Registration and Acceptance
Submission of registration does not guarantee acceptance into any program. Villarreal Houston reserves the right to accept, deny, suspend, or terminate any player or family participation at its sole discretion.
2. Financial Commitment
Enrollment in any Villarreal Houston Soccer Academy program constitutes a financial commitment for the full seasonal year, term, program, or service period selected.
The Club makes substantial financial commitments including but not limited to:

League registrations
-
Coaching contracts
-
Field rentals
-
Tournament registrations
-
Administrative expenses
-
Equipment purchases
-
Insurance and operating costs
Because these costs are incurred in advance, all fees are non-refundable and non-transferable.
3. No Refund Policy
ALL PAYMENTS MADE TO VILLARREAL HOUSTON ARE FINAL.
No refunds shall be issued for:

Voluntary withdrawal from the Club
-
Player transfer to another club
-
Dissatisfaction with playing time
-
Coaching decisions
-
Team placement
-
Schedule conflicts
-
Injuries or illnesses
-
Relocation
-
Family circumstances
-
Academic commitments
-
Changes in personal circumstances
-
Weather-related cancellations when reasonable alternatives are provided
-
Any unused portion of services
Once a player accepts a roster position and/or completes registration, the financial obligation remains in effect regardless of participation status.
4. No Credits Policy
Villarreal Houston does not provide:

Account credits
-
Future program credits
-
Make-up credits
-
Service credits
-
Transfer credits
-
Cash equivalents
Missed practices, games, training sessions, camps, tournaments, or events will not result in credits or financial adjustments.
5. Payment Obligations
Families remain responsible for all scheduled payments under their selected payment plan.
Failure to attend, participate, or complete the season does not eliminate financial obligations.
Any outstanding balance shall become immediately due upon withdrawal, suspension, termination, or transfer of the player.
6. Delinquent Accounts and Collections
Accounts with unpaid balances may be subject to:

Late fees
-
Administrative collection fees
-
Collection agency placement
-
Legal action
-
Recovery of attorney's fees where permitted by law
-
Recovery of court costs where permitted by law
The member agrees that Villarreal Houston may pursue all lawful remedies available to recover unpaid balances.
Participation privileges may be suspended until all financial obligations have been satisfied.
7. Chargebacks and Payment Disputes
Initiating a chargeback, payment reversal, or disputed transaction for valid services rendered constitutes a breach of this agreement.
Villarreal Houston reserves the right to:

Contest and dispute any chargeback

Provide documentation supporting services rendered

Recover administrative costs associated with defending disputes
-
Suspend or terminate participation
-
Pursue collection of unpaid balances
8. Club Authority and Termination Rights
Villarreal Houston reserves the right to suspend or terminate participation for any reason including but not limited to:

Violation of Club policies
-
Unsportsmanlike conduct
-
Harassment
-
Abuse toward players, coaches, staff, referees, volunteers, or spectators
-
Repeated disruption of Club activities
-
Non-payment of fees
Termination by the Club does not automatically entitle a family to any refund or credit.
9. Playing Time and Team Placement
Participation does not guarantee:
-
Playing time
-
Starting positions
-
Team selection
-
Advancement opportunities
-
College recruitment opportunities
-
Professional opportunities
All player development decisions remain solely within the discretion of Club staff.
10. Communications and Conduct
Parents, players, and guests are expected to conduct themselves respectfully at all times.
Abusive, threatening, discriminatory, harassing, or defamatory behavior directed toward coaches, staff, officials, players, volunteers, or other families may result in disciplinary action or termination.
11. Public Statements and Reputation Protection
Families agree not to knowingly publish or communicate false, misleading, defamatory, harassing, or malicious statements regarding Villarreal Houston, its coaches, staff, volunteers, players, sponsors, or affiliated organizations.
Nothing in this policy is intended to restrict lawful consumer reviews or legally protected speech.
12. Assumption of Risk
Participation in soccer and athletic activities involves inherent risks including but not limited to:

Physical injury
-
Permanent disability
-
Illness
-
Property damage
Participants voluntarily assume all risks associated with participation.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Villarreal Houston, its owners, directors, employees, contractors, coaches, volunteers, sponsors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in any Club activity.
14. Media Release
Unless prohibited in writing, Villarreal Houston may use photographs, videos, recordings, and other media of participants for promotional, educational, marketing, and social media purposes without compensation.
15. Policy Modifications
Villarreal Houston reserves the right to modify these policies at any time. Continued participation constitutes acceptance of any revised policies.
16. Agreement
By registering for any Villarreal Houston Soccer Academy program, the participant and parent/guardian acknowledge that they have read, understood, and voluntarily agree to be legally bound by these Terms of Service and Club Policies.
VILLARREAL HOUSTON SOCCER ACADEMY
Arbitration, Venue & Dispute Resolution Agreement
Mandatory Informal Resolution
Prior to initiating any legal claim, the parties agree to attempt good-faith resolution through written notice submitted to the Club.
The parties shall have thirty (30) days to attempt resolution before initiating formal proceedings.
Binding Arbitration
Except where prohibited by law, any dispute, claim, controversy, or cause of action arising out of or related to:

Membership
-
Registration
-
Services
-
Payments
-
Participation
-
Coaching decisions
-
Club operations
-
Club policies
shall be resolved exclusively through binding arbitration.
Arbitration Rules
Arbitration shall be conducted:

In Harris County, Texas
-
Under the rules of the American Arbitration Association (AAA) or similar arbitration provider selected by the Club
-
By a single arbitrator
Waiver of Jury Trial
The participant and parent/guardian knowingly waive any right to a jury trial.
Class Action Waiver
Claims must be brought individually.
Participants waive any right to participate in:

Class actions
-
Collective actions
-
Representative actions
against Villarreal Houston.
Governing Law
This Agreement shall be governed by the laws of the State of Texas.
Venue
If arbitration is deemed unenforceable by a court of competent jurisdiction, exclusive venue shall be Harris County, Texas.
Attorney Fees
The prevailing party in any dispute may recover reasonable attorney fees, costs, and expenses to the extent permitted by law.
